Terms and Conditions — GhostAnswer

These Terms and Conditions (“Terms”) govern access to and use of GhostAnswer, including our website, desktop application, overlay, dashboard, AI features, accounts, free plans, paid plans, documentation, support, and any related service.

By accessing, downloading, installing, creating an account, signing in, paying for a subscription, or using GhostAnswer, you accept these Terms. If you do not accept these Terms, you must not use GhostAnswer.

GhostAnswer is an artificial intelligence assistance tool designed to help users generate answers, explanations, summaries, or suggestions from text provided by the user.

GhostAnswer may include:

• Desktop application.
• Visual overlay.
• Keyboard shortcuts.
• Configuration dashboard.
• Brief response or explanation modes.
• Processing through AI models.
• User authentication.
• Free plan.
• Pro plan or other paid plans.
• Integration with external providers, including AI, payment, and authentication providers.

GhostAnswer does not guarantee that generated responses will be accurate, complete, legal, current, or appropriate for every context.

To use GhostAnswer, you must:

• Be at least 13 years old or the minimum legal age in your jurisdiction.
• Have legal capacity to accept these Terms.
• Use GhostAnswer in accordance with applicable law.
• Not be prohibited from using the service by applicable laws, sanctions, or restrictions.

If you use GhostAnswer on behalf of a company or organization, you represent that you have authority to accept these Terms on behalf of that entity.

To access certain features, you may need an account. You agree to provide accurate, current, and complete information.

You are responsible for:

• Maintaining the confidentiality of your credentials.
• All activities performed through your account.
• Notifying us if you suspect unauthorized access.
• Keeping your email up to date.

We may suspend or terminate accounts that violate these Terms, create abuse, fraud, security risk, or legal non-compliance.

If you use Google to sign in or authorize Google permissions, you agree that GhostAnswer may access and process the authorized data as described in our Privacy Policy.

GhostAnswer will use Google data only for the purposes described in the Privacy Policy and in accordance with the Google API Services User Data Policy, including the Limited Use requirements.

You may revoke access from your Google account at any time.

You may use GhostAnswer to:

• Generate answers to your own questions.
• Obtain explanations.
• Summarize text that you have the right to process.
• Improve productivity.
• Create drafts.
• Receive writing assistance.
• Prepare for conversations, studies, or permitted tasks.
• Analyze your own or authorized content.

You may not use GhostAnswer to:

• Violate laws or regulations.
• Infringe intellectual property, privacy, or confidentiality rights.
• Process data that you do not have the right to use.
• Deceive, defraud, impersonate others, or bypass security systems.
• Cheat on exams, interviews, assessments, certifications, or processes where external assistance is prohibited.
• Violate policies of employers, educational institutions, platforms, or third parties.
• Generate spam, phishing, malware, social engineering, abuse, or harmful content.
• Extract, copy, or store third-party data without authorization.
• Use GhostAnswer for surveillance, credit scoring, discrimination, illegal advertising, or unauthorized sensitive decision-making.
• Resell, sublicense, or commercially exploit GhostAnswer without written authorization.
• Attempt to access systems, APIs, models, accounts, or data without permission.
• Circumvent usage limits, plans, payments, or security mechanisms.

The user is responsible for verifying whether GhostAnswer may be used in each context. GhostAnswer does not authorize uses prohibited by schools, companies, platforms, or applicable laws.

“User Content” means any text, question, document, message, instruction, image, file, data, or information that you provide, copy, paste, upload, or process through GhostAnswer.

You retain your rights to your User Content. By using GhostAnswer, you grant us a limited, worldwide, non-exclusive license necessary to process your content solely to provide, protect, and improve the service, generate requested responses, maintain security, comply with legal obligations, and provide support.

You represent that you have the rights necessary to provide and process that content through GhostAnswer.

GhostAnswer may generate responses through artificial intelligence models. You understand and agree that:

• Responses may be inaccurate, incomplete, offensive, outdated, or unsuitable.
• You must review and validate any response before using it.
• You must not rely on GhostAnswer as your sole source for legal, medical, financial, academic, employment, technical, security, or high-impact decisions.
• GhostAnswer does not replace professional advice.
• The user is responsible for the final use of the responses.

GhostAnswer may offer free plans and paid plans.

The free plan may have usage limits, reduced features, or restrictions. The Pro plan or other plans may include higher limits, additional features, or priority, as stated on the pricing page.

When purchasing a subscription:

• You agree to pay the applicable fees.
• You authorize the payment processor to charge the applicable amounts.
• Your subscription may renew automatically unless cancelled.
• Prices, features, and limits may change with reasonable notice.
• Certain promotions may have additional conditions.

You may cancel your subscription through the available billing portal, by writing to support@ghostanswers.com, or through the method we indicate inside the application.

Cancellation prevents future renewals but does not necessarily create an automatic refund for periods already paid, unless applicable law requires it or GhostAnswer states a different policy.

Subject to these Terms, GhostAnswer grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download, install, and use the application only for permitted personal or internal purposes.

You may not:

• Copy, modify, distribute, or sell the application.
• Reverse engineer, decompile, or attempt to extract source code, except where allowed by law.
• Circumvent license, payment, or security controls.
• Use the application to create an unauthorized competing product.
• Remove intellectual property notices.

GhostAnswer, including its name, logo, interface, design, code, documentation, integration models, brand, text, and materials, belongs to GhostAnswer or its licensors.

These Terms do not transfer intellectual property rights in GhostAnswer to you. You receive only the limited right of use described in these Terms.

GhostAnswer may rely on third-party services, including:

• Artificial intelligence providers.
• Hosting providers.
• Payment processors such as Stripe.
• Authentication services such as Google.
• Analytics, security, or support tools.

Use of those services may be subject to additional terms and privacy policies. GhostAnswer does not control all acts of independent third parties, but selects providers necessary to operate the service.

The Privacy Policy explains what data we collect, how we use it, how we share it, how we protect it, and how you can request deletion.

We may modify, suspend, limit, or discontinue parts of GhostAnswer at any time, including features, models, limits, plans, or integrations.

We will make reasonable efforts to keep the service available, but we do not guarantee continuous, error-free, or uninterrupted availability.

Some features may be beta, experimental, or limited availability. These features may change, fail, generate incorrect results, or be removed without prior notice.

You must not attempt to compromise GhostAnswer’s security. This includes:

• Accessing accounts that are not yours.
• Testing vulnerabilities without authorization.
• Interfering with infrastructure.
• Automating abuse.
• Bypassing rate limits.
• Manipulating payments, plans, or tokens.

We may investigate suspicious activity and suspend accounts when necessary.

You may stop using GhostAnswer at any time.

We may suspend or terminate your access if:

• You violate these Terms.
• You create legal, technical, or security risk.
• You use the service abusively.
• You fail to pay applicable fees.
• We must comply with a law, order, or requirement.
• Your use may harm GhostAnswer, users, or third parties.

After termination, certain provisions will remain in effect, including intellectual property, limitation of liability, indemnification, pending payments, privacy, and dispute resolution.

GhostAnswer is provided “as is” and “as available.” To the extent permitted by law, we do not provide express or implied warranties regarding:

• Accuracy of responses.
• Continuous availability.
• Absence of errors.
• Fitness for a particular purpose.
• Specific results.
• Compatibility with all devices or systems.
• Absence of data loss.

To the maximum extent permitted by law, GhostAnswer will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of revenue, data, opportunities, reputation, savings, use, or profits.

GhostAnswer’s total liability for any claim related to the service will not exceed the amount you paid to GhostAnswer during the three months before the event giving rise to the claim, or one hundred U.S. dollars, whichever is greater, unless applicable law requires otherwise.

You agree to indemnify and hold harmless GhostAnswer, its owners, employees, contractors, providers, and affiliates from claims, damages, losses, liabilities, costs, and expenses arising from:

• Your use of GhostAnswer.
• Your User Content.
• Your violation of these Terms.
• Your violation of laws or third-party rights.
• Your misuse of AI-generated responses.

These Terms will be governed by the laws of Guadalajara, Jalisco, Mexico, without regard to conflict-of-law principles.

Any dispute will be submitted to the competent courts of Guadalajara, Jalisco, Mexico, unless applicable law establishes another mandatory forum.

We may update these Terms from time to time. We will publish the updated version on our website and indicate the last updated date.

If the changes are material, we may notify you by email, inside the application, or through a notice on the website. Continued use of GhostAnswer after the changes means acceptance of the updated Terms.
